Effective January 2023, these are the terms and conditions governing the use of Nexus Dispatch Group’s services, operated by NEXUS DISPATCH GROUP LLC and its affiliates (“Provider,” “we,” or “us”), located at 312 W 2nd St PMB 5378, Casper, WY 82601, United States. The Provider may offer products and services on the Site, with or without its use. These products and services are appended to the definition of “the Service” or “the Services,” and this document applies equally and interchangeably to them.
By accessing or using the Services, you signify that you have read, understood, and agreed to be bound by these terms and conditions (“Terms of Service” or “Agreement”). Users of the Services (“you”) must agree to this Agreement in order to access or use the Services. These Terms of Service, along with the Provider’s Privacy Policy, constitute a binding agreement between you and the Provider.
Acceptance of the Agreement Each time you access or use the Services, you signify your acceptance of this Agreement, without limitation or qualification, and agree to comply with all applicable laws and regulations. If you do not want to agree to these Terms of Service, do not access or use the Services. Scope of this Agreement These Terms of Service apply only to your activities when using the Services or its contents. From time to time, we may establish or authorize the Provider’s service provider to establish Provider-branded services that operate under different terms and conditions. Those different terms and conditions will be linked to that service’s home page. Please review such different terms and conditions if you choose to visit those sites, as they govern your use thereof. These Terms of Service do not affect or amend the terms of any other contracts you have entered into or may enter into with the Provider or a Provider affiliate, except as otherwise expressly set forth in such Provider Contract.
Authority The Provider provides the Services for use primarily by persons located in the United States and is based in the State of Texas in the United States. The Services are not intended to be used by persons located outside of the United States. The Provider makes no claims that the Services or any of its content is accessible or appropriate outside of the United States. Access to the Services may not be legal by certain persons or in certain countries. If you access the Services from outside the United States, you do so on your own initiative and you accept full responsibility for ensuring compliance with local laws.
Changes to these Terms of Service We reserve the right to modify, suspend, or terminate the operation of the Services, its content, and offerings, in whole or in part, in our sole discretion, at any time and for any reason. From time to time, the Provider may, in its sole discretion, change, supplement, or amend these Terms of Service, or require that you agree to additional terms and conditions (“Revised Terms”) in order to continue using the Services. Access to some areas of the Services may be limited to users who have been authenticated and granted permission by the Provider. The Provider reserves its right to revoke permission to access such areas of the Services for any reason.

Nexus Dispatch Group’s Provider Privacy Policy explains our practices concerning the collection, use, storage, and disclosure of your information, including personal information, that you provide through our Services. By using our Services, you consent to our Privacy Policy, which is incorporated into and forms part of these Terms of Service.
Services Ownership; Copyrights and Trademarks; Intellectual Property Rights
Nexus Dispatch Group, its affiliates, and/or their licensors own the Services, its content, features, functionality, and systems, including copyright and all rights to trademarks and service marks used on the site, and all other intellectual property rights therein. All rights not expressly granted or licensed herein are reserved to Nexus Dispatch Group, its affiliates, or licensors. The Services and their entire contents, data, software, code, features, functionality (including but not limited to all information, text, displays, images, video, audio, and the design, selection, and arrangement thereof) materials, processes, procedures, methods, techniques, and any other content (collectively “Data and Information”) are owned by Nexus Dispatch Group, its affiliates, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property and proprietary rights (hereinafter “Intellectual Property Rights”). You acknowledge, understand, and agree that Nexus Dispatch Group retains all Intellectual Property Rights in and to all Data and Information, excluding Data and Information that you may provide. Nexus Dispatch Group and its affiliates’ trademarks and service marks (many of which are registered in the United States and other countries) may appear with the Services from time to time, including, without limitation, the following examples as applicable (collectively, the “Nexus Dispatch Group LLC Trademarks”). Other product, service, and company names appearing in the Services may be the trademarks of their respective owners and are used by Nexus Dispatch Group via license or under “fair use” principles. Unauthorized use of any such Trademarks, including reproduction, imitation, dilution, or confusing or misleading uses, is prohibited under the trademark laws of the United States and other countries. No right or license to use any of these trademarks is granted in these Terms of Service. Nexus Dispatch Group or its affiliates are the owners of all domain names that link to the Nexus Dispatch Group sites in the US and internationally and/or relate to the business of Nexus Dispatch Group, and unauthorized use of these names or any of them is not permitted. If you print, copy, modify, download, or otherwise use or provide any other person with access to any part of the Services in breach of the Terms of Service, your right to use the Services will stop immediately, and you must, at our option, return or destroy any copies of the materials you have made. No right, title, or interest in or to the Services or any content with the Services is transferred to you, and all rights not expressly granted are reserved by Nexus Dispatch Group. Subject to these Terms of Service and any further restrictions set forth in the Revised Terms, Nexus Dispatch Group grants you a non-exclusive, limited, non-sublicensable, non-transferable, revocable license (“Limited License”) to access the Services and use the information, features, functions, and content made available to you with the Services solely in connection with Nexus Dispatch Group-related or Nexus Dispatch Group affiliate-related business and not for purposes of competing with Nexus Dispatch Group.
Disclaimer of Warranties; Limitation of Liability
The services and all information, data, content, software, code, features, functionality, materials, and processes contained therein, are provided “as is” and “as available” without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, non-infringement or title, or warranties arising from course of dealing, course of performance, or usage of trade. the provider does not warrant that the services will be uninterrupted or error-free, that defects will be corrected or that the services or the server(s) that make the services available are free of viruses or other harmful components or that the services will meet your needs or expectations. the provider is not responsible for any data loss or other loss that may occur as a result of your use of the services. your use of the services is at your sole risk.
To the fullest extent permitted by law, the provider, its affiliates, and their respective officers, directors, employees, agents, suppliers, and licensors shall not be liable to you or anyone else for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or in connection with the use or inability to use the services, including, without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses (even if we have been advised of the possibility of such damages), resulting from: (a) the use or inability to use the services; (b) the cost of procurement of substitute goods and services resulting from any goods, data, information, or services obtained or messages received or transactions entered into through or from the services; (c) unauthorized access to or alteration of your transmissions or data; (d) statements or conduct of any third party on the services; (e) or any other matter relating to the services.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. accordingly, some of the above limitations may not apply to you. to the extent that we may not, as a matter of applicable law, disclaim any implied warranty or limit our liabilities, the scope and duration of such warranty and the extent of our liability shall be the minimum permitted under such applicable law.
In no event shall the provider’s total liability to you for all damages, losses, and causes of action (whether in contract, tort (including, but not limited to, negligence), or otherwise) exceed the greater of the amount paid by you, if any, for accessing the services or $50. any claims arising in connection with your use of the services must be brought within one (1) year of the date of the event giving rise to such action occurred. if you are dissatisfied with any portion of the services, or with any of these terms of service, your sole and exclusive remedy is to discontinue using the services.
